Can a TRT applications be on the last day of validity if it is a two year Subclass 457/TSS visa which is part of the transitional regulations?  The answer is YES!

The immigration regulations were not completely clear on this however the policy which is associated with the legislation and which all decision makers within the Department of Home Affairs consult, has been updated to reflect this.  The legislation will be updated also in due course.  This means that those who would be entitled to apply for PR after two years are able to do this on the last day of their 457/482 visa without having to apply for a new temporary visa.   There is no risk now of their ENS 186 (PR) application being refused.  A big relief and cost saving for all, employers and visa applicants alike!
